The use of the Havally website is subject to acceptance of these Terms and Conditions. By visiting Havally, you accept and consent to these Terms and Conditions. If you do not agree to the Terms and Conditions, you must not use or access this website.

These Terms and Conditions may change from time to time without notice, and Havally recommends you check back regularly.

These Terms and Conditions do not affect your statutory rights (including the right to insist that goods you buy from businesses must correspond with their description, be fit for their purpose and be of satisfactory quality).

These Terms and Conditions shall prevail over any separate terms put forward by you. Any conditions that you communicate in whatever form and at whatever time, whether in writing, by email or orally, are expressly waived and excluded.

Every effort has been made to ensure the information contained on the website is correct, however, Havally makes no warranty as to the accuracy or comprehensiveness of any products displayed and/or sold and provides all products on an “as is” basis.

Havally is not liable for any losses or damages caused by this website or any website linked to or from this website.

Your privacy is of the utmost importance to us. Our Privacy Policy details how we collect, protect, store and use personal information you provide to us and forms part of our Terms and Conditions.


Pricing and GST
All prices on the website are quoted in Australian Dollars and include GST. Sale prices are based on savings from regular price. Regular prices are based on recommended retail price as set by suppliers and the market.

All prices are subject to change and prices displayed are only valid online at the time shown.


Customer Communications
Havally will communicate with you about your order by email and phone. By registering or ordering on Havally you grant us the right to add your contact details to our database. From time to time we may send you marketing material about offers and new products. If you do not wish to receive such material, you may unsubscribe via the link on the email communication, edit your newsletter settings under My Account or by contacting our Customer Service Team at service@havally.com.au.


Order Acceptance
Your receipt of an electronic or other order confirmation does not signify our acceptance of your order or our offer to sell. Havally reserves the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment. We may require additional verifications or information before accepting any order.


Order Cancellation
You may cancel your order before the order is dispatched by Havally and we will refund you in full for the orders cancelled. We will not charge you a cancellation fee. However, once the order is dispatched for delivery you are unable to cancel the order but may return the order as outlined in our Returns & Exchanges Policy.

Havally reserves the right to cancel your order if we are unable to process payment on the credit card provided or you provide unauthorised payment details; if the personal details you provide are invalid; or if, when required you are not able to provide satisfactory proof of identity. In addition, Havally reserves the right to cancel your order if the product has become unavailable or if, for any reason, we believe we cannot successfully complete delivery.

Havally will attempt to notify you before cancelling your order.


Account Suspension and Termination
Havally reserves the right to suspend or terminate your account at any time without prior notice to you, if you breach these Terms and Conditions. If your account is suspended or terminated, you will not be able to access the Website.

In the event of Account Suspension or Termination and you are waiting delivery of products, Havally reserves the right to cancel your order. A refund may be issued to the credit card provided during the purchase process.


Delivery
Havally offers standard shipping within Australia as detailed in our Shipping Policy. The delivery times provided are estimates only.

It might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.

We deliver in our standard packaging. Any special packaging requested by you is subject to additional charges.

Havally will not be accountable for late deliveries or loss or for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.


Acceptance of Goods
On delivery of the order, you agree to inspect the goods for any faults, defects or damage and notify us within 5 working days of receiving the goods should there be a fault.


Returns and Refunds
You may return items purchased at Havally for a full refund within 21 days of purchase. To qualify for a full refund items must be in an undamaged and unmarked condition and in their original undamaged packaging and labelling.

You are responsible for the postage cost of returning products purchased. Upon receipt of the product, you may choose to return the product to Havally for a full refund if the product is faulty when you receive it. Faults will be assessed by our Customer Service Team and we may also consult with the supplier/manufacturer. If the product is found to be faulty you will receive a full refund, including any postage paid by you, otherwise the product will be returned to you.

Refunds will be issued in accordance with our Returns Policy and will only be made to the original account used for payment. In some limited circumstances we may make a refund to an alternate account if the original has been cancelled or is not available. Havally will not consider requests for refunds after 21 days of purchase, unless the product is deemed faulty by our Customer Service Team.

Loss of Goods
The risk of loss of goods shall be passed to you upon our delivery of the product to Havally’s nominated delivery company. Havally will not be held responsible for any loss, damage or liability as a result of this authority.


Warranties
It is your responsibility to ensure that the products purchased are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the products will meet your individual requirements.

All warranties offered are the manufacturer’s warranties and not that of Havally.


Promotions
Havally may use promotional vouchers or coupons for products on the site. If you have a promotional voucher, that voucher can be used by someone other than you and you can assign your rights to use that voucher. The value and expiry is specified on the voucher. Vouchers may only be redeemed once during checkout on Havally and by clicking “Apply Coupon”.

Vouchers CANNOT be used in conjunction with other promotional vouchers, used on sale items or redeemed for cash. Individual brands may be excluded from voucher promotions.

If you place an order for a product less than the value of the promotional voucher, no refund or residual credit will be returned to you. Furthermore, if the credit of a promotional voucher is insufficient for the order you wish to make, you may make up the difference through payment.

Fixed dollar discount coupons can only be applied to orders of $30 or more.


Disputes
Your satisfaction is important to us and we welcome your feedback – good and bad. If you have a complaint please let us know via Contact Us. We will try to address your concerns as soon as reasonably possible and will contact you on receipt of any relevant enquiry or complaint. In some cases, the manufacturer or other third party may be involved, and as such it may take longer to resolve such an enquiry or complaint.

In the event of a complaint it will help us if you can describe the object of your complaint as accurately as possible and, where applicable, send us copies of the order or at least the order number that we assign you in the

Acknowledgement or Confirmation of Order. Should you not have received any reaction from us within five business days, please make further enquiries. Very occasionally your emails may be caught up in our spam filters or not reach us, or correspondence that we send to you may otherwise not have reached you.


Advertising and Links
 Havally shall endeavour to ensure that any advertising contained on the site shall comply with any relevant regulations published by the Advertising Standards Authority.

The website may contain links to other websites on the Internet that are owned and operated by Havally Pty Ltd. You acknowledge that we are not responsible for the operation of or content located on or through any such site.
